In Virginia there are multiple code sections for reckless driving. The most commonly issued summons is for reckless driving by speeding.

What may appear as a simple traffic infraction for speeding may actually be a charge of reckless driving; which is a criminal offense and a class one misdemeanor. In Virginia, a class one misdemeanor is the most serious misdemeanor. The maximum penalty for reckless driving is 12 months jail, a $2,500 fine and a six month license suspension.

A charge of DUI is also a class one misdemeanor.

And, unfortunately for out-of-state residents, not being aware of Virginia's harsh driving laws does not constitute a legal defense. Even motorists who have not endangered life or property, but have been clocked driving at 20 mph over the posted speed limit or over 80 mph in any posted speed limit (including 70 mph zones), may be arrested or issued a summons for reckless driving. In Virginia, speed alone may support a charge of reckless driving.

A motorist traveling in a 70 mph zone on a Virginia interstate at 3:00 a.m., without another motorist within a mile's distance, may be arrested or issued a summons for reckless driving if he is clocked at 81 mph or higher, by a law enforcement officer.

Though a class one misdemeanor requires the defendant's court appearance, some of the policies of the local courts may allow defense counsel to appear in court on behalf of out-of-state defendants or for defendants for other valid reasons.
